Copyright and DMCA
How we handle copyright notices, counter-notices and repeat infringers.
We respect the rights of people who make music, film and writing, and we expect everyone who adds something to Firestarters to do the same. If something here copies your work without permission, tell us and we will take it down. If something of yours was taken down by mistake, you can answer.
Our designated agent
Our registration with the U.S. Copyright Office’s DMCA Designated Agent Directory is pending. Until it is listed here, send notices with the copyright notice form or by email to support@firestarters.us.
Sending a notice
The quickest way is our copyright notice form. A notice must include:
- your physical or electronic signature (typing your full name is enough);
- the copyrighted work you say is being copied, or a list of them;
- where the material is on Firestarters, as a web address, so we can find it;
- your name, postal address, phone number and email;
- a statement that you believe in good faith the use isn’t authorized by the copyright owner, its agent or the law;
- a statement that the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for them.
We review every notice. When one is complete, we remove the material and tell the person or ministry who added it. A notice that leaves something out may not be acted on until it is complete. Knowingly misstating that material infringes can make you liable for damages (17 U.S.C. §512(f)).
Answering a takedown (counter-notice)
If we removed something you added and you believe it was a mistake or misidentified, sign in and send a counter-notice. The person who added it, or an owner or admin of the ministry’s page, can send one. It must include:
- your signature, name, postal address and phone number;
- what was removed and where it appeared before it was removed;
- a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
- your consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district where Firestarters may be found), and that you will accept service of process from the person who sent the notice.
We send your counter-notice, including your contact details, to the person who sent the notice. Unless they tell us within 10 business days that they have filed a court action to keep the material down, we put it back between 10 and 14 business days after we received your counter-notice.
Repeat infringers
We end the accounts and access of repeat infringers in appropriate circumstances. When three notices against the same ministry or artist page are upheld, that page can no longer upload clips. When three are upheld against the same person, they lose their roles on every ministry team, any page they own is held for our team to reassign, and they can’t be added to a team again. A notice stops counting if the material is restored after a counter-notice or the notice is withdrawn. Our team reviews every case and can lift these limits.
